Parrella Health Law reports that legal scrutiny of payer AI-driven utilization management has intensified after a federal court in Minnesota ordered UnitedHealth Group to produce internal documents about its nH Predict algorithm—an AI tool allegedly used in coverage decisions for Medicare Advantage patients. The ruling (in Estate of Lokken v. UnitedHealth Group) does not decide the merits of the case, but it allows plaintiffs to seek discovery on how the algorithm works, its development goals, intended benefits, and whether it was designed to replace physician judgment. The court also required disclosure of the individuals involved in the tool’s design, implementation, and approval—bringing new transparency to how coverage algorithms are conceived and deployed. The post argues this matters beyond UnitedHealth: providers across hospitals, post-acute, and behavioral health increasingly report denials that feel automated or disconnected from the clinical record. The author advises providers to document denial patterns, track language/timing/appeal outcomes, and strengthen medical-necessity documentation as AI-driven denials become a growing litigation and regulatory battleground.
